This was the message attorneys from throughout Western New York shared with the New York State Commission on the Future of Indigent Defense Services on Friday, March 11. Housing Prices Up as Building Permits Rise Housing prices in the Winchester-Frederick County area soared in 2001. Median prices for homes in those two jurisdictions that were sold through the Blue Ridge Association of Realtors rose to $140,800, a 12% increase from 2000, double the 6.2% increase experienced in the rest of the nation. The Winchester-Frederick area is now the most expensive real estate market in the Quad-state region, except for its neighbor to the east, Clarke County, where the median price was $220,000. (It should be noted that the median price is the point as which 50% of sales occur at higher prices, and 50% at lower prices. This is considered a better measure than average price, which may be influenced by one or more large transactions.)

MY FRIEND Ian Sturrock once went to a fancy-dress party as the Menai Straits. He wore a sack, to which he attached rusty tins, seaweed, shells, bits of driftwood, used condoms and dead crabs. To complete the tableau, he put a kipper under each arm. He didnt win a prize or even get many dances. But he said that everyone looked at him. He was well pleased. But even Ian would have been staggered at the total looniness of the Australian Neil Wilson, the man who wanted to be a fish. Wilson has just been found dead at Toolondo, near Victoria. Strangely, he did not drown, but suffocated in the fish-shaped bodysuit he had made from heavy green plastic sheeting. Unfortunately, he had clearly not read as far as chapter three in How To Be A Fish, because in the costume he had forgotten to put in ventilation slits. He was discovered by a passer-by in a field close to Wilsons favourite reservoir, “where he was a familiar sight at the waters edge, swinging from a rope while pretending to be a fish”, my cutting says. Im afraid I cant tell you any more. Thats a shame, because this intriguing tale clearly raises more questions than it answers.

QUESTION: Recently, administrators informed us that OR staff members must wear name tags, and they have provided us with lanyards to wear attached to the name tags. What is AORNs position on wearing a name tag in the OR? If a name tag is required, can we wear the lanyards around our necks, or are these considered in the same category as necklaces? Like a necklace, a name tag could be a potential source of contamination if the lanyard is dangling around the neck of perioperative personnel during prepping or when the person is near the sterile field. During this time, the name tag should be secured in a pocket or under a snapped warm-up jacket to prevent it from dangling or falling into the surgical area and leading to possible contamination. An alternative method of attaching the name tag (eg, a pin, a clip) may decrease the risk of the name tag contaminating the sterile field or a prepped area. The attaching device should be washable and securely attached to decrease the chance that it will fall off. Examples of devices that may not be acceptable include, but are not limited to,
Im not a big fan of firearm lanyards. Yes, I thought they were pretty cool when the Marines first issued me one in 1964, but the cool factor only applied to the way they looked, not the way they worked. As long as I didnt actually have to draw my 1911, the lanyard worked fine, and it did look cool. However, once the pistol was drawn, the lanyard became a big pain in the six oclock. It snagged on everything and got in the way during reholstering. Now, Pistol Leash Unlimited comes to the rescue. This is a smart why didnt I think of that product. Designed by a federal agent, who I will not ID because he can and will hurt me, the Pistol Leash does what a lanyard is supposed to do: work. The cord is a snappy coil, like the one attached to your telephone, that permits full extension of the firearm, yet retracts when tension is released. Just as smart is the way the Pistol Leash is attached to the belt keeper. A small metal bar allows the cord to slide back, out of the way during the motion of reholstering. There is no need to use two hands to reholster, or worse, look down while you use the muzzle to brush the lanyard aside.

But, after this particular incident, I noted there was a very good reason to have a lanyard on my pistol.

No, malpractice payouts have been growing at about 4 percent per year since 1991, or about the rate of inflation, and the average payout to an aggrieved patient is about $113,000. Of course this doesnt stop some members of Congress from continuing to talk about the crushing costs of malpractice litigation and insurance premiums. Maybe they should update their homework. A new report by the Consumer Federation of America points out that malpractice insurance premiums, after rising at 40 to 60 percent annually in the early part of this decade, have slowed to less than 2 percent annually during the last year. Interestingly, premiums rose just as fast in states that cap malpractice awards as in those that dont.

The 33rd annual Home Improvement Show will open its four-day run Feb. 9 at State Fair Park with the theme, “The Premier Showing of Ideas for Your Home.” Co-sponsored by the Milwaukee / NARI Home Improvement Council and the Milwaukee Sentinel, its more than 275 exhibitors will give an expected crowd of 35,000 people tips and information on how to spruce up or remodel their homes. During the late 19th century, climbers who conquered Alpine peaks such as the Matterhorn and Mont Blanc managed to do so without the benefit of synthetic fleeces and lightweight tents. Indeed, one of their number, the Italian Vittorio Sella, even lugged his old- fashioned camera with him every step of the way. It was worth the effort, though, as his stunning records of the views from the top confirm. Malcolm McCulloughs Abstracting Craft makes a particularly compelling argument for the validity of embodied knowledge. “Academics,” McCullough states at the outset, “despite a growing faction interested in body criticism, generally ignore the hands in their epistemologies of mind” (5). A professor of architecture at Harvard Universitys Graduate School of Design, McCullough notes that within the limited experiential frame of computer production there are major obstacles to the acquisition of what he refers to under the rubric of craft. His argument reflects an ongoing concern expressed by traditionally trained artists as they watch a new generation adept only at scanning, appropriation, and the use of software. (Their fear: computer design students never learn to draw.) His suggestion is to reconceptualize electronic tools so that they are used not “so much for automating tasks as for abstracting craft” (81). Paradoxically, what McCullough bemoans is the process of abstraction that introduces the distance between hand and material, mind and process. By emphasizing the hand as an instrument essential to epistemological development, cognitive processes, and artistic articulation, he proposes a synthetic resolution of traditional craft and new technology rather than pitting them in an apparently inevitable, unproductive opposition. Unfortunately he stops short of assessing the ways in which the conceptual premises of software products have ignored or incorporated assumptions about what constitutes embodied knowledge in specific terms. Immersed in Technology, an anthology edited by Mary Anne Moser and Douglas MacLeod, also address issues of physicality. A welcome counterpoint to the exaggerated rhetoric of popular journalism on the topic, this sophisticated volume came out of the Canadian Art Centre at Banff, which has provided a forum for ongoing investigation of the intersections between art and technology. The books contributors are artists who are either technicians or are sufficiently close to the technical processes to have no illusions about them. These are people directly involved in working with so-called immersant technologies (three-dimensional, real-time illusions involving multiple sensory stimulation). The editors establish the tone of the book in their introduction, where they frankly acknowledge the sometimes contentious character of exchanges among the artists involved (certainly a healthy feature of an anthology). Katherine Hayles notes that even the core notion of virtual reality was fraught with misleading inaccuracies and says that the Banff group proposed the term “embodied virtuality” as an (albeit controversial) alternative. The books finely honed critical edge, informed by a cultural studies approach to gender and politics, succeeds in deflating mythic fantasies about the virtual. Chief among these is that of total escape from ones body, identity, and life that drives much of the Wired-type hype surrounding electronic art.

Visiphor Corporation (”Visiphor” or the
“Corporation”) (OTCBB: VISRF) (TSX-V: VIS) (XETRA: IGYA) announces today it
has issued 120,662 Units at $0.40 per Unit to settle $48,264.77 of debt.
This debt settlement was previously announced on July 13, 2004; however,
issuance of the Units was delayed due to the creditors estate settlement.
Each Unit consists of one common share and one common share purchase
warrant. Each warrant will entitle the holder for two years from the date
of issue of the Units to acquire one additional common share in the capital
of Visiphor at an exercise price of $0.50 in the first year and $0.75 in
the second year. The common shares and warrants will be subject to a
four-month hold period that expires on June 19, 2007.

STACKPAL INTERNATIONAL INC. (CDN: STAX)/STACKPAL CANADA INC. reported today that management has reached an agreement with the longterm debt holder to convert the debt to equity. The Company was indebted to the licensor and owner of a polymer pallet leg patent in the amount of approximately $1.2 million. Pursuant to a debt settlement agreement made as of February 28, 1997, the Company issued 1,084,370 common shares to the debt holder, at a stated capital of $0.20 per share, $216,874 in the aggregate, in consideration for a full and final release from the licensor of all outstanding indebtedness. The licensor retains a $0.02 per unit royalty for each unit of polymer pallet leg sold by Stackpal. The Company and its subsidiaries retain all existing licensing and marketing rights to the polymer pallet leg as contemplated in prior agreements with the licensor. The conversion of debt to equity resulted in a one-time charge for forgiveness of debt of $1.0 million, recorded in 1997.
